Why Contact A Lawyer After Denial of Canadian Pension Plan Disability Benefits? July 29, 2019

If you have been involved in an accident, you may have received injuries that make it too difficult to work or to do the same things you are used to doing throughout your day. You may be advised by your injury lawyer in Red Deer, doctor, or even friends and family to go and file for disability when you become too financially burdened and need to make a change. It does take a while to hear anything back about your disability benefits or if you even qualify. Applications are normally screened through in a process that is most fair for every applicant. During this time, you will feel stressed out because you are still receiving bills coming in continuously and you don’t have the money in your account to cover them nor do you know how long it will be before you do.

About Canada Pension Plan

If an individual is unable to work in any job, then they would first apply for disability benefits. The amount that you will receive once your application is approved will depend on several factors, such as how much you were contributing to the disability fund prior to your injury and the number of years you have been working.

There is also a maximum you can be offered for disability depending on these factors and a few more. Every application that is eligible will receive a certain amount each week in order to get them through.

In order for a child to be eligible for benefits, they will need to be under the age of eighteen and no older than twenty-five. They will only receive benefits if they are considered a full-time student and can provide proof that they are currently attending.

Am I entitled to CPP disability benefits?

The first thing that the disability office will ask you for is proof of how long you have contributed to any disability funds. If you have made contribution for twenty-five years, then you will be eligible. While this seems like a lot of time, it really isn’t because disability is not a big expense from your check anyway.

If your disability doesn’t seem to be temporary because your injuries were more extensive, then you may want to inquire about other disability that you may qualify for to cover long term and terminal illnesses.

What happens if my claim is denied?

If you have filed a claim and it has been denied, then what do you do? You need a way to make money and pay your bills but you cannot go back to work yet and you certainly don’t feel like you can. You also need to pay those bills that keep piling up in your mailbox.

So what will happen first, is the medical adjudicators will look over your case and determine what happened during and after the accident, look over your medical records to determine what injuries you received, and to compare your diagnosis with other diagnosis known around the world to determine first if your case is legitimate and if so, how much they can allot you for your disability. They also take into consideration:

• The effects of your condition on your ability to work
• The prognosis for recovery
• Your current age, any education your received as well as your work history
• Your performance at work, your earnings, and your productivity
