KEEP IN MIND THESE THINGS FOR A SMOOTH PERSONAL INJURY CLAIM March 15, 2021

Personal injury claims can be very complicated, which is why you need someone to help you with the legal process: a personal injury lawyer that has previous experience with claims similar to yours and that has courtroom experience. In this article, you will learn a few pieces of advice that will make your personal injury claim smoother.

COMPENSATION CLAIMS ARE NOT EASY

Compensation claims, in general, are not easy. There are some exceptions, such as personal injury claims due to road traffic accidents, which can be pretty simple. But not all personal injury claims pertain to road traffic accidents, and the severer the injuries, the more complex the claim will be.

Bringing a claim to someone must be carefully thought before proceeding to action. So it is important to think about all the benefits and drawbacks of the claim and to weigh them.

GET MEDICAL EVIDENCE

Usually, insurance companies will answer a personal injury claim by offering an amount of compensation straight away. It is almost completely unfeasible to quantify a claim if the attorney lacks medical evidence.

Sometimes, accepting prompt offers is the best thing to do, but they must be carefully considered anyway just in case posterior medical treatment and other financial losses due to the injury end up surpassing the compensation offered by the insurers.

DON’T RUSH YOUR CLAIM

Claims should only be settled in the case of a complete physical and psychological recovery. Unless you sustained a permanent injury during the accident, you should wait until you fully recover before settling the case.

If the medical evidence states that you are completely recovered, then the time has come to finally settle the claim. Considering the possible scenarios that may occur by settling the claim before full recovery will show why waiting a bit longer is a better idea:

HYPOTHETICAL SCENARIO

Even if the doctor says it is anticipated that you completely recover in a given amount of time, say six months, and you decide to settle the claim by trusting the doctor’s prediction, there are two possible outcomes: either the doctor was right and you recover in six months, or the doctor made a mistake and you do not fully recover.

In hypothetical case number two, you will have to end up paying more than the value of the compensation that was given to you by the at-fault party’s insurance company.
